Terms of Service
These terms govern your access to and use of Potly.
1. Agreement
These Terms are an agreement between you and Gaige Moore, operator of Potly. They apply to the Potly app, potly.xyz, and related services. By creating an account or using Potly, you agree to these Terms and the Privacy Policy.
2. Eligibility
You must be legally able to enter this agreement. Potly is not intended for children under 13. You are responsible for complying with age restrictions and poker, gaming, or gambling laws that apply where you use Potly.
3. What Potly provides
Potly provides tools for organizing and recording private poker games, including game creation, participation, chip and buy-in tracking, settlement calculations, game history, templates, reports, and statistics. Features may change over time.
4. Not a gambling or payment service
Potly does not operate poker games, accept wagers, determine winners, hold or transfer player funds, provide escrow, collect debts, or process player-to-player payments. Hosts and participants are responsible for ensuring their activities are lawful and for resolving payment or settlement disputes.
5. Accounts
You must provide accurate information, protect your credentials, and notify support@potly.xyz if you believe your account has been compromised.
6. Game information
You retain ownership of information you submit. You grant Potly a limited license to host, process, reproduce, and display it as needed to operate, secure, and improve the Services. Game information may be shared with the applicable host and participants. You are responsible for reviewing records and calculations before relying on them.
7. Acceptable use
- Do not use Potly for unlawful, fraudulent, abusive, or deceptive activity.
- Do not facilitate unlawful gambling or money transmission.
- Do not access another user’s account or data without authorization.
- Do not interfere with Potly systems or security controls.
- Do not submit information you are not authorized to share.
8. Potly+ subscriptions
Potly+ is an optional auto-renewing subscription. Current pricing, billing periods, and trial terms are shown before purchase. Apple processes purchases, renewals, cancellations, and eligible refunds. Deleting the app or Potly account does not automatically cancel an Apple subscription.
9. Intellectual property
Potly’s software, design, branding, and original content are owned by Gaige Moore or licensed to him. Potly grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose.
10. Suspension and termination
You may stop using Potly at any time and may initiate account deletion from the app. We may suspend or terminate access when reasonably necessary to protect the Services or others, address violations, comply with law, or prevent abuse.
11. Disclaimers
To the maximum extent permitted by law, Potly is provided “as is” and “as available.” Potly does not guarantee uninterrupted operation or error-free game, settlement, financial, tax, or statistical information. Nothing in Potly is legal, tax, financial, gambling, or accounting advice.
12. Limitation of liability
To the maximum extent permitted by law, Gaige Moore and Potly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities. Total liability for claims relating to the Services will not exceed the greater of the amount you paid Potly during the preceding 12 months or 50 U.S. dollars. Some jurisdictions may not allow certain limits.
13. Governing law and disputes
These Terms are governed by the laws applicable in the principal place from which Gaige Moore operates Potly, except where consumer law requires otherwise. Before filing a formal claim, contact legal@potly.xyz and attempt in good faith to resolve the matter informally for at least 30 days.
14. Changes
We may update these Terms as Potly, law, or business practices change. The updated version and effective date will be posted here.
